1. Acceptance of Terms
By accessing or using any Orbital Host service, website, control panel, billing portal,
API, or related infrastructure, you agree to be bound by these Terms of Service.
If you do not agree to these Terms, you may not use our services.
These Terms apply to all customers, visitors, users, account holders, and any person
accessing services provisioned by Orbital Host.
2. Definitions
- “Company,” “Orbital Host,” “we,” “us,” or “our” means Orbital Host and its operated services.
- “Services” means all hosting products and related offerings, including but not limited to game hosting, Discord bot hosting, Lavalink hosting, VPS services, dedicated servers, websites, support systems, APIs, and panels.
- “Customer,” “user,” or “you” means the person or entity purchasing, accessing, managing, or using the Services.
- “Content” means all files, data, code, software, media, server configurations, logs, databases, and material stored, transmitted, or hosted through the Services.
- “Billing Cycle” means the recurring service period stated at checkout, invoice, or service order form.
3. Eligibility & Account Responsibility
- You must provide accurate, current, and complete account and billing information at all times.
- You are responsible for maintaining the security of your account, passwords, API keys, access tokens, and panel credentials.
- You are responsible for all activity occurring under your account, whether performed by you or by another person using your credentials.
- You must notify us immediately if you believe your account or service has been accessed without authorization.
- You may not impersonate another person, use misleading account details, or provide fraudulent identity or billing information.
- If you are under the age of majority in your jurisdiction, you may only use the Services with permission and supervision of a parent or legal guardian.
4. Services
Orbital Host provides infrastructure and hosting-related services. Specific plan details,
resource allocations, limits, hardware tiers, locations, supported software, and included
features are described on the applicable product page, invoice, order summary, or service panel.
- Services are provided on an as-available and as-provisioned basis.
- Not all services include managed administration, code review, plugin support, or software debugging unless explicitly stated.
- We may modify infrastructure, nodes, locations, virtualization platforms, and service architecture when reasonably necessary for operations, performance, maintenance, or security.
- Abuse prevention, network protection, and service stability may require traffic filtering, rate limiting, temporary routing adjustments, or emergency intervention.
5. Billing & Renewals
- Services may be offered on recurring or one-time billing terms as stated at checkout.
- Recurring services renew automatically unless cancelled before the next invoice due date.
- You are responsible for cancelling any third-party subscription or payment agreement tied to your service, including PayPal or card-based recurring authorizations.
- Invoices must be paid on or before the due date shown in the billing portal.
- If payment is not received by the due date, services may be suspended, limited, or terminated.
- We may apply late fees, administrative fees, reactivation fees, or fraud review holds where permitted by law or commercially necessary.
- Prices, taxes, product specifications, and included resources may change with notice prior to renewal where applicable.
6. Refunds & Chargebacks
- Unless otherwise stated in writing or required by law, payments are non-refundable once a service has been provisioned, renewed, or delivered.
- Any goodwill refund granted by Orbital Host is discretionary, partial or full at our sole determination, and does not create an ongoing obligation to provide future refunds.
- Setup fees, custom work, migration work, software licensing costs, domain registrations, and add-ons are generally non-refundable.
- Refund requests made after substantial resource usage, abuse incidents, or extensive support time may be denied.
- Filing a chargeback, payment dispute, or unauthorized payment claim may result in immediate suspension or permanent termination of all related services and accounts.
- We reserve the right to submit account history, invoice records, login history, provisioning logs, support tickets, and service usage data in response to a payment dispute.
7. Suspension, Termination & Data Deletion
- We may suspend, restrict, or terminate any service immediately if we reasonably believe it is being used in violation of these Terms, the Acceptable Use Policy, applicable law, or network safety requirements.
- We may suspend services for overdue invoices, fraud review, abuse complaints, excessive resource usage, security threats, or emergency maintenance.
- Suspension does not waive your obligation to pay outstanding balances.
- After suspension or termination, data may become inaccessible immediately.
- Following termination for non-payment, abuse, or customer cancellation, we may permanently delete data, backups, snapshots, and related service content without further notice.
- It is your responsibility to maintain your own current off-platform backups before cancellation, suspension, or termination.
8. Acceptable Use Policy
You may not use Orbital Host services for unlawful, harmful, fraudulent, abusive,
or operationally disruptive activity. Prohibited activity includes, but is not limited to:
- Malware distribution, phishing, credential theft, botnets, remote exploitation, or unauthorized access attempts.
- Launching, facilitating, coordinating, or relaying denial-of-service attacks or traffic flooding of any kind.
- Hosting content that is unlawful, exploitative, obscene, or clearly intended to harass, threaten, or abuse others.
- Spam operations, mass unsolicited messaging, deceptive redirects, or abusive automation.
- Cryptocurrency mining on services where it is not expressly allowed.
- Use of services in a way that causes serious instability, sustained abuse of shared resources, or material degradation of other customers’ services.
- Copyright infringement, software piracy, sale of stolen data, or use of content you do not have rights to host or distribute.
- Misrepresentation of your identity, affiliation, or authorization.
- Attempts to bypass service limits, node restrictions, abuse controls, account suspensions, or security systems.
We reserve full discretion to determine whether activity is abusive, harmful, deceptive,
or inconsistent with safe operation of the platform.
9. Customer Content & Responsibility
- You retain ownership of your Content, but you are solely responsible for its legality, security, integrity, and use.
- You represent that you own your Content or have all necessary permissions and rights to upload, host, process, and distribute it through the Services.
- We do not monitor all hosted content and are not responsible for user-generated or customer-managed content.
- Where reasonably necessary, we may investigate files, logs, service behavior, ports, processes, or configurations to address abuse, security incidents, or support requests.
- We may remove, disable, isolate, or restrict access to Content or services that create legal, security, operational, or abuse concerns.
10. Backups & Data Loss
- You are solely responsible for maintaining your own backups unless a managed backup feature is explicitly included with your service.
- Any backups, snapshots, restore points, or automated copies provided by Orbital Host are offered on a best-effort basis unless otherwise stated in writing.
- We do not guarantee the existence, accuracy, recoverability, or successful restoration of any backup.
- Orbital Host is not liable for lost files, corrupted databases, overwritten content, failed restores, panel errors, customer misconfiguration, or third-party software issues.
11. Uptime, Performance & Support
- We aim to provide reliable, high-performance services, but uninterrupted uptime, perfect latency, and error-free operation are not guaranteed.
- Downtime may occur due to maintenance, upstream outages, DDoS events, hardware faults, software defects, datacenter incidents, control panel issues, or force majeure events.
- Support is provided according to available channels, queue volume, and issue severity.
- We are not responsible for problems caused by unsupported software, customer-installed code, broken plugins, conflicting mods, poor configuration, or third-party APIs.
12. Third-Party Services
- Our services may integrate with or rely on third-party providers, including payment processors, software vendors, APIs, datacenters, DNS providers, domain registrars, game platforms, and panel software.
- Third-party systems operate under their own terms, uptime commitments, policies, and privacy practices.
- We are not responsible for downtime, policy actions, account restrictions, software bugs, or data handling performed by third-party services outside our direct control.
13. Intellectual Property & DMCA
- All Orbital Host branding, website content, design elements, graphics, service descriptions, and proprietary systems remain the property of Orbital Host or its licensors unless otherwise stated.
- You may not copy, resell, reproduce, reverse engineer, or redistribute our protected materials except as permitted by law or with written authorization.
- If you believe hosted content infringes your copyright, you may submit a DMCA-style notice containing the claimed work, the allegedly infringing material, your contact details, and a good-faith statement of your authority and claim.
- We may remove or disable access to material alleged to be infringing and may terminate repeat infringers where appropriate.
14. Disclaimers
Services are provided on an “as is” and “as available” basis to the maximum extent
permitted by law. Orbital Host disclaims all warranties, express or implied, including
warranties of merchantability, fitness for a particular purpose, non-infringement,
uninterrupted availability, and fitness of services for any specific commercial, gaming,
development, or distribution use case.
15. Limitation of Liability
- To the maximum extent permitted by law, Orbital Host shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
- This includes, without limitation, loss of profits, loss of revenue, loss of data, corruption of files, service interruption, downtime, business interruption, reputational harm, or procurement of substitute services.
- To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Services shall not exceed the amount you paid to Orbital Host for the affected service during the three months immediately preceding the event giving rise to the claim.
16. Indemnification
You agree to defend, indemnify, and hold harmless Orbital Host, its owners, staff,
contractors, infrastructure partners, and affiliates from and against any claims,
damages, liabilities, judgments, losses, fines, investigations, and expenses,
including reasonable attorneys’ fees, arising out of or related to your use of the
Services, your Content, your violation of these Terms, or your violation of any law
or third-party right.
17. Changes to Services or Terms
- We may modify, replace, suspend, discontinue, or reprice any service, feature, or plan at any time.
- We may update these Terms of Service from time to time by posting a revised version on this page.
- Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable
in the jurisdiction in which Orbital Host operates, without regard to conflict of law principles,
except where local consumer protection laws require otherwise.
